MUSCAT : According to a statement from the CPA, the Primary Court in Al Mudhaibi issued a judicial ruling against a commercial establishment and its representative for violating Oman’s Consumer Protection Law, after failing to provide services in a proper manner and failing to issue an invoice in the Arabic language. The court ruled to convict the defendants and impose financial fines.
The details of the case date back to the Authority receiving a complaint from a consumer who had contracted with the establishment to repair a vehicle defect related to overheating, in addition to fully repainting the vehicle, for a total amount of RO 255, of which RO 70 was paid as an advance. The establishment later requested an additional RO 50, which was paid, and asked the consumer to provide spare parts, with a commitment to complete the work within two weeks.
However, the establishment failed to complete the work within the agreed period. Upon receiving the vehicle, the consumer discovered that the defect persisted. He returned the vehicle to the workshop in an attempt to rectify the issue, but without success. After retrieving the vehicle, the consumer found that some parts were missing and incurred further losses when repairing the vehicle at another workshop, prompting him to file a complaint with the Authority.
Following the Authority’s procedures, the case was referred to the Public Prosecution, which conducted the investigation before transferring the case to the competent court. The court issued a ruling convicting the owner of the establishment and its representative, imposing financial fines for the charges brought against them. The civil claim was referred to the competent civil court.
