Oman’s CPA secures over RO 5,000 for Suwaiq resident after undisclosed vehicle accident

The Consumer Protection Authority (CPA) in North Al Batinah Governorate, through its Suwaiq office, has successfully recovered RO 5,075 for a consumer who purchased a vehicle with an undisclosed serious accident history.

MUSCAT : The CPA facilitated an amicable settlement between a consumer and a commercial vehicle sales company, resulting in the recovery of the purchased amount.

The case began when a consumer filed a complaint with the Consumer Protection Office, stating that he had agreed to purchase a 2018 Toyota Avalon from a vehicle sales company.

He had paid an advance of RO 5,075 for the vehicle, which was disclosed to have been involved in a minor accident. Upon receiving the car, however, the consumer discovered that the vehicle had actually been involved in a serious accident, far beyond what was initially communicated.

The consumer immediately contacted the vehicle sales company to address the issue, but the company refused to accept the return of the vehicle or refund the amount paid. Frustrated by the lack of response, the consumer submitted his complaint to the Consumer Protection Office in Suwaiq, which in turn took the procedures followed in such cases.

An amicable settlement was reached, which included returning the vehicle to the establishment and refunding the amount paid in advance to the consumer. It is worth noting that the legal guarantee, according to Article (29) of the Consumer Protection Law issued by Royal Decree No. (66/2014), stipulates that “the supplier who trades in used goods or goods containing a defect must disclose to the consumer the condition of this goods and prove this in the contract or invoice he issues, as specified in the regulations.”

The Consumer Protection Authority is urging all suppliers to comply with consumer protection laws, ensuring that they meet their obligations and responsibilities. This helps safeguard consumers’ rights and promotes trust in the marketplace.
