Oman’s Labour Ministry tightens grip on Labour Law violations, issues new ministerial resolution

The Ministry of Labour has issued Ministerial Decision No. 450/2024, outlining new procedures and controls for dealing with private sector establishments that violate the provisions of the Labour Law and the decisions implementing it.

MUSCAT : According to the resolution, judicial law enforcement officers are responsible for monitoring and documenting violations related to labour regulations. These officers must carry identification indicating their judicial police status and present it upon request when performing their duties.

When a violation is detected, the authorized officers are required to prepare a detailed report. This report must include:

  • The date, time, and location of the incident, as well as the nature of the violation.
  • The name and signature of the officer recording the incident.
  • The name and description of the person involved, whether the establishment owner or an employee.
  • The signature of the facility owner or an attending employee. If they refuse to sign or accept a copy of the report, this refusal must be noted.

    Following the documentation of a violation, officers are to prepare a memorandum on the subject of the violation that includes proof of the violation, and submit it to the director of the relevant department, or his replacement.

    If the violation is confirmed, the competent department director, or their replacement, has the authority to suspend specific services provided to the establishment. These services include:
  • Issuing new work permits for non-Omani workers.
  • Renewing work permits for the affected worker.
  • Amending or recording data related to the violating worker.
  • Transferring or canceling work-related notices for the worker.

The suspension of these services will be lifted once the violation is rectified and any applicable fines are paid, as determined by the competent department director or their deputy.
