MUSCAT – The verdict includes both criminal and civil penalties after the company failed to provide services as agreed with a consumer.
According to a statement from the Consumer Protection Authority (CPA), its department in South Al Batinah Governorate – Rustaq, received a complaint from a consumer stating that he had contracted a commercial establishment operating in the field of household furniture to design and install windows for his residence at a total cost of RO 2,470. He had paid an advance of RO 1,400, with a mutual agreement that the project would be completed within one month. However, the establishment failed to meet the agreed terms, prompting the consumer to file a formal complaint.
Upon investigation, it was found that the establishment had not only failed to complete the service but also breached service guarantees, constituting a violation of Articles 23 and 39 of the Consumer Protection Law. These provisions mandate that services must be provided in accordance with the agreed terms and ensure proper delivery of services to the consumer.

The business owner expressed willingness to refund the advance payment but proposed doing so in monthly instalments of RO 150. Nevertheless, legal procedures were initiated.
The court, after reviewing the case, convicted the owner of the misdemeanour of failing to provide the service in the required manner. He was sentenced to one month of imprisonment and fined RO 100.
In the civil ruling, the court ordered the defendant to pay RO 1,400 to the complainant and to bear all judicial expenses. Other compensation claims made by the consumer, including a request for RO 4,000 in damages, were dismissed.
