MUSCAT: The Sohar Court of First Instance recently sentenced two defendants, who were accused of a misdemeanor of non-compliance with refunding the amount paid by the consumer during the warranty period, to imprisonment and a fine.
The details of the ruling refer to a consumer’s contract with a manpower recruitment agency in exchange for OMR 850, but the worker ran away from the house during the warranty period and after searching for her, the consumer was able to find her, and immediately returned her to the office, but he did not receive the amount that he paid it in advance, and accordingly he went to the General Directorate of Consumer Protection in Sohar to submit his complaint, demanding a refund for the amount he had paid.
In turn, the Directorate took inference procedures and then referred the case to the Public Prosecution, which decided to refer it to the competent court. For committing a misdemeanor of non-compliance with providing the service to the consumer in a proper manner and in accordance with its nature, the two individuals were sentenced to imprisonment for five months and a fine estimated at OMR 1,000 with an order to stop the penalty according to the reasons for the ruling, and for a civil one, obligating the first accused to pay the civil right claimant an amount of OMR 1050 with expenses.
