Commercial establishment in Barka fined RO 1,200 for violating Oman’s Consumer Protection Law

The Primary Court of the Wilayat of Barka has issued a judicial ruling against a commercial establishment for violating the Consumer Protection Law, imposing financial penalties amounting to RO 1,200.

MUSCAT – The case originated after a consumer filed a complaint with the Consumer Protection Authority (CPA) in Barka.

According to the complaint, the individual had purchased an air conditioning unit for RO 219. However, months after delivery, the unit developed a malfunction in its cooling system. Despite four repair attempts by the establishment, the issue persisted, leading the consumer to lodge a complaint with the authorities.

Following an investigation, the CPA referred the case to the Public Prosecution, which forwarded the matter to the competent court. In a public hearing, the court found the two defendants guilty of the misdemeanour of “failure to provide the service properly and in accordance with its nature.” Each defendant was handed a financial fine of RO 600. The execution of this sentence was suspended on the condition that the total due amount is paid within one month. The court also mandated the defendants to cover all legal expenses.

In a separate civil ruling, the court ordered the termination of the contract between the two parties. Furthermore, the commercial establishment was obligated to refund the device’s value, amounting to RO 210, and to compensate the consumer with an additional RO 50 for damages incurred.

The Authority reiterated its call for all commercial establishments to comply fully with the laws and regulations in force. It also affirmed its ongoing commitment to safeguarding consumer rights and ensuring the delivery of goods and services that meet established quality standards.
