Consumers can service vehicles outside the agency, says Oman’s CPA

Consumers have the right to service their vehicles outside the agency if the vehicle is still under the factory warranty period, says the Consumer Protection Authority (CPA).

MUSCAT : The Authority has issued a notice to apprise consumers of the rights and privileges that they can avail with regards to vehicle maintenance, payment methods, price discrepancies and refunds.


In reply to the common question pertaining to vehicle maintenance, CPA states: “The consumer has the right to maintain the vehicle outside the agency, even if the vehicle is still under the factory warranty period, provided that the maintenance is done according to the vehicle warranty booklet, with all the invoices in hand. However, if the vehicle is under the extended warranty, the consumer must comply with the provisions of that warranty in the maintenance process.”


As far as payment methods are concerned, the CPA gave the example of a carpentry shop insisting on payment in full prior to the delivery of the product, in this case doors, to explain that such demand constitutes unfair practice. “Obliging the consumer to pay the price in full before receiving the goods or service is considered an unfair practice. Therefore, if the shop insists on this, please file a complaint to take the necessary action,” it urged.


Presenting another scenario, where the price charged by a store is higher than the listed price of the product, the Authority informed that Clause 12 of Article 19 of the executive regulations of the Consumer Protection Law categorically stipulates that the shop/provider is prohibited from charging a price that is higher than the one advertised on the product.


“Therefore, this matter is considered a violation and you can report it immediately to take the necessary action by those concerned,” it explained.


On the issue of exchanges and refunds for purchased items, the CPA posed the following question to highlight the rights available to consumers – Do I have the right to replace the item or get refund if the product has the same malfunction even after replacing it?


“According to the Consumer Protection Law, the consumer has the right to replace the commodity or get the money refunded within 15 days from the date of receipt, if it was defective or did not conform to specifications and standards, or did not fulfill the purpose for which the contract was concluded,” said the CPA.
