Business establishment in Oman’s Barka penalised for failing to honour AC unit warranty

The Primary Court in Barka has convicted the owner of a commercial establishment and his partner for violating the provisions of the Consumer Protection Law by failing to repair or replace a defective air conditioning unit covered under warranty.

MUSCAT – According to a statement issued by the Consumer Protection Authority (CPA), the case originated from a complaint filed by a consumer who had purchased 11 air conditioning units worth more than RO 2,000 from the establishment.

One of the units, which was under warranty, was found to be defective. However, the establishment failed to repair or replace the faulty unit despite the consumer’s repeated attempts to have the issue resolved.
The Authority pointed out that the establishment’s actions constituted a violation of Article 23 of the law, which obliges suppliers to provide services properly and to honour warranty obligations for goods and services. Following an investigation, the case was referred to the Public Prosecution, which in turn submitted it to the competent court.

The court ruled to convict both defendants, imposing a suspended financial penalty of RO 200 on each and ordering them to pay procedural costs.

The Consumer Protection Authority reaffirmed its commitment to monitoring compliance among suppliers and service providers, emphasizing that it will not hesitate to take legal action against violators to protect consumer rights and ensure fair market practices.
